Auto Parts Price Fixing MDL Brings More Than $1 Billion in Settlements

A Robins Kaplan partner was appointed co-lead counsel of a landmark MDL that has already secured more than $1 billion in settlements for victims of auto parts industry conspiracies. This unprecedented case, which stems from one of the most comprehensive criminal antitrust investigations in U.S. history, encompasses more than forty separate actions filed against more than 160 defendants. This case has unique timelines, different auto parts, and numerous defendants and conspirators.

End-payor purchasers

The plaintiffs, known as End-Payors (EPPs), have filed a class action lawsuit against the Defendants for allegedly rigging bids and fixing prices. The Plaintiffs’ class action complaint alleges that the Defendants overcharged consumers for automotive parts. In particular, the lawsuit claims that the Defendants overcharged consumers for the Instrument Panel Cluster, a key component of vehicles.

Class action settlements

Consumers who purchased a new vehicle between 1990 and 1996 may be eligible to receive a class action settlement. This $1.2 billion auto parts price-fixing lawsuit offers consumers in 31 states the opportunity to claim $100 for each vehicle they own. The antitrust division filed a price-fixing lawsuit against the DuPont auto parts company in June, and the company has been sentenced to pay more than $1.6 billion in criminal fines. The case has also included 21 executives and companies. Of the 21 executives and companies, 17 have pleaded guilty or entered plea deals calling for significant prison sentences. One of the executives, Gary Walker, was sentenced to 14 months in federal prison and paid a criminal fine of $200,000.
